These Terms of Use (“Terms”) govern access to and use of the AskBetti software platform, website (www.askbetti.com), applications, APIs, and related services (collectively, the “Services”) provided by Paramount Technology Solutions, LLC d/b/a AskBetti (“AskBetti,” “Company,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
If you do not agree, you may not use the Services.
1. The Services
AskBetti is a software-as-a-service (SaaS) platform providing guided on-screen learning, digital adoption support, workflow enablement tools, analytics, and related functionality for enterprise organizations.
We may update, enhance, or modify features from time to time.
2. Accounts and Access
You must:
Provide accurate registration information
Maintain the confidentiality of login credentials
Restrict access to authorized users only
Notify us of unauthorized access
You are responsible for all activity under your account.
We reserve the right to suspend accounts that violate these Terms.
3. License Grant
Subject to these Terms and payment of applicable fees, AskBetti grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes during your subscription term.
No ownership rights are transferred.
4. Acceptable Use
You may not:
Reverse engineer or attempt to access source code
Circumvent security controls
Introduce malware
Use the Services for unlawful purposes
Interfere with system integrity or performance
Use the Services to violate intellectual property or privacy rights
We may suspend access for violations.
5. Subscription Terms and Billing
This section governs your subscription to AskBetti Services.
5.1 Subscription Plans
Access to the Services is provided on a subscription basis under:
Monthly subscription plans
Annual subscription plans
Enterprise agreements under separately executed Order Forms or Master Services Agreements
Subscription details, pricing, user limits, and feature access are defined in your Order Form, invoice, or online checkout.
5.2 Fees
You agree to pay all fees specified in your Order Form or checkout page.
Unless otherwise stated:
Fees are quoted in U.S. dollars
Fees are non-refundable
Fees are exclusive of taxes
You are responsible for all applicable taxes, duties, or government charges.
5.3 Billing and Payment
Subscriptions may be billed:
Monthly in advance
Annually in advance
Pursuant to enterprise invoicing terms
If paying by credit card:
You authorize us to charge your payment method automatically
Subscriptions automatically renew unless cancelled
If paying by invoice:
Payment is due within the stated payment terms (e.g., Net 30)
Late payments may incur interest at the lesser of 1.5% per month or the maximum allowed by law
We may suspend Services for nonpayment.
5.4 Auto-Renewal
Unless otherwise specified in writing:
Subscriptions automatically renew for successive terms equal to the original term
Renewal fees will be at the then-current rates
You may cancel prior to renewal by providing written notice at least 10 days before renewal
5.5 User Limits and Overage
If your subscription includes user limits, usage thresholds, or feature caps:
You may not exceed those limits without upgrading
- We may require plan adjustments
5.6 No Refunds
Except as required by law or explicitly stated in a signed agreement:
All fees are non-refundable
Partial months or unused subscription periods are not refunded
6. Customer Data
You retain ownership of data you upload or input into the Services (“Customer Data”).
You grant AskBetti a limited license to:
Host
Process
Transmit
Backup
Customer Data solely for providing the Services.
We do not sell Customer Data.
7. Intellectual Property
All rights, title, and interest in the Services, including:
Software
Designs
Interfaces
Content
Trademarks
Improvements
remain the exclusive property of Paramount Technology Solutions, LLC d/b/a AskBetti.
Feedback you provide may be used by us without restriction or compensation.
8. Confidentiality
Each party agrees to protect confidential information disclosed in connection with the Services and use it only for authorized purposes.
9. Warranty Disclaimer
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
We do not warrant uninterrupted or error-free operation.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
AskBetti’s total liability arising out of or related to the Services shall not exceed the total amount paid by Customer in the twelve (12) months preceding the claim.
We are not liable for:
Indirect damages
Lost profits
Loss of data
Business interruption
Consequential or punitive damages
11. Indemnification
You agree to indemnify and hold harmless AskBetti from claims arising from:
Your use of the Services
Violation of these Terms
Violation of law
Infringement of third-party rights
12. Suspension and Termination
We may suspend access if:
Fees are unpaid
You violate these Terms
Security risks are detected
Upon termination:
Your access ceases
We may delete data per our retention policy
Payment obligations survive
13. Governing Law
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles.
Venue shall be in New Hampshire courts unless otherwise agreed in writing.
14. Modifications
We may update these Terms periodically. Continued use after updates constitutes acceptance.
15. Entire Agreement
These Terms, the Privacy Policy, and any Order Form or MSA constitute the entire agreement between the parties.
